The terms and conditions for using AI Christmas Photo Generator from Goedleven LLC.

1. Acceptance of Terms

By accessing or using the AI Christmas Photo website and services (the "Service") provided by Goedleven LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Eligibility & Age Restriction

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age. If you are under 18, you may not use the Service.

3. User Conduct & Content Policy

A. Your Content

You retain all ownership rights to the photos you upload ("Source Images"). You grant us a limited, non-exclusive license to process your Source Images solely for the purpose of providing the Service to you.

B. Prohibited Content (Zero Tolerance)

You strictly agree NOT to upload or generate:

  • Non-Consensual Images: Photos of any person other than yourself. You represent you own the copyright or have explicit permission for every photo you upload.
  • Minors: Photos of children, unless you are their parent or legal guardian.
  • NSFW/Adult Content: Nudity, pornography, or sexually explicit content.
  • Illegal Content: Child Sexual Abuse Material (CSAM) or content promoting violence/hate speech.

Violation of this policy will result in an immediate and permanent ban without refund. We report all suspected CSAM to the National Center for Missing & Exploited Children (NCMEC) and relevant authorities.

4. Generated Content Ownership

Subject to your compliance with these Terms, you own all rights, title, and interest in the images generated by the Service for you ("Generated Images"). You may use them for personal or commercial purposes.

5. DMCA Copyright Policy

We respect the intellectual property rights of others. If you believe that any material available on our Service infringes upon your copyright, please notify our Designated Copyright Agent at support@aichristmasphoto.com.

Please include: (1) description of the copyrighted work; (2) URL where the material is located; (3) your contact info; and (4) a statement that you have a good faith belief that the use is unauthorized.

6. Privacy and Data Protection

Our collection and use of personal data is governed by our Privacy Policy. We implement appropriate technical and organizational measures to protect your data.

7. Payment Terms

  • Payment: We use Stripe for secure one-time payments.
  • Refunds: We offer refunds within 14 days of purchase if you are not satisfied with the result, subject to our Returns Policy. We reserve the right to deny refunds in cases of suspected abuse or policy violations.

8. Virtual Credits & Purchases

  • No Monetary Value: Credits purchased are virtual goods and have no real-world monetary value. They cannot be exchanged for cash or transferred to other accounts.
  • Expiration: We reserve the right to expire unused credits if an account remains inactive for 12 months, subject to applicable law.
  • Service Availability: We rely on third-party AI providers. We do not guarantee 100% uptime. We are not liable for any delays or failures in generation caused by provider outages (e.g., OpenAI/RunPod downtime).

9. Disclaimers

The Service uses experimental Artificial Intelligence technology. We cannot guarantee that the results will be error-free or that they will perfectly resemble the subject. The Service is provided "AS IS" without warranties of any kind.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOEDLEVEN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ARISING FROM YOUR USE OF THE SERVICE.

11. Dispute Resolution; Binding Arbitration

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in the State of Delaware, rather than in court. You waive any right to a jury trial or to participate in a class action lawsuit.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
